Terms of Service

Welcome to Fuse! These Terms of Service ("Terms") govern your use of the Fuse mobile application ("App") operated by Fuse Interactive LLC ("we," "our," or "us"). By using Fuse, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

To use Fuse, you must:

• Be at least 18 years of age
• Be legally able to enter into a binding contract
• Not be prohibited from using the App under applicable laws
• Not have been previously banned from Fuse

By creating an account, you represent and warrant that you meet all eligibility requirements.

2. Your Account

When you create a Fuse account, you agree to:

• Provide accurate, current, and complete information
• Maintain only one account per person
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

3. User Conduct

You agree NOT to:

• Harass, bully, stalk, intimidate, or threaten other users
• Post content that is hateful, discriminatory, violent, or sexually explicit
• Impersonate any person or misrepresent your identity, age, or affiliation
• Use the App for any illegal purpose or to solicit illegal activities
• Spam, solicit money, or advertise goods/services
• Share other users' personal information without consent
• Use automated systems, bots, or scripts to access the App
• Attempt to interfere with or disrupt the App's functionality
• Upload viruses, malware, or other harmful code

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, warning users, suspending accounts, or banning users permanently.

4. Your Content

Ownership: You retain ownership of the photos, text, and other content you upload to Fuse ("Your Content").

License to Fuse: By uploading content, you grant Fuse a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the App's services (e.g., showing your profile to other users).

Content Standards: You represent that Your Content:

• Is accurate and truthful
• Does not infringe on any third party's rights
• Complies with all applicable laws
• Does not contain illegal, harmful, or objectionable material

5. Interactions with Other Users

You are solely responsible for your interactions with other users. Fuse does not conduct background checks on users and makes no guarantees about user behavior or identity.

Safety Tips:

• Never share financial information or send money to other users
• Meet in public places for first meetings
• Tell a friend or family member about your plans
• Report suspicious or inappropriate behavior

6. Termination

By You: You may delete your account at any time through the App's settings.

By Us: We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the App
• Requests by law enforcement or government agencies

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• That you will find matches or romantic connections
• That the App will be uninterrupted, secure, or error-free
• The accuracy, reliability, or completeness of any user content
• The behavior, identity, or intentions of other users

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUSE INTERACTIVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Personal injury or property damage resulting from your use of the App
• Any conduct or content of any third party on the App
• Unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid to Fuse in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Fuse Interactive LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by other means. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
