Welcome to Fuse! These Terms of Service ("Terms" or "Agreement") govern your use of the Fuse mobile application ("App") and related services (collectively, the "Services") operated by Fuse Interactive LLC ("Fuse," "we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
To use Fuse, you represent and warrant that you:
If at any time you cease to meet any of these requirements, your authorization to use the Services is automatically revoked, and you must immediately stop using the Services and delete your account. We reserve the right to delete your account and revoke access without notice if we believe you no longer meet these requirements.
When you create a Fuse account, you agree to:

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, warning users, suspending accounts, banning users permanently, IP blocking, and reporting to law enforcement. The license granted to you under these Terms is automatically revoked if you violate any of the above.
Zero Tolerance. Fuse has zero tolerance for objectionable content or abusive behavior, including but not limited to: nudity or sexually explicit material, hate symbols, harassment, threats of violence, sexual harassment, content promoting or glorifying violence, content depicting illegal activity, impersonation, scams, or solicitation. Any user found posting such content or engaging in such behavior will have their content removed and their account suspended or permanently banned, without notice and at our sole discretion.
Reporting. Users may report objectionable content or abusive behavior using the in-app Report feature on any profile or message, or by emailing contact@fuseapp.co. We commit to reviewing all reports and taking appropriate action within twenty-four (24) hours of submission. Action may include content removal, account suspension, permanent ban, IP block, or referral to law enforcement.
Blocking. Users may block any other user at any time through the in-app Block feature. Blocked users will not be able to view your profile, send you messages, or appear in your discovery feed.
Pre-Screening. We pre-screen all uploaded profile photos using a combination of automated tools and manual review before they are made visible to other users. Photos that violate these Terms will be rejected at upload and will not appear in the App.
Cooperation with Law Enforcement. You acknowledge and agree that Fuse may access, preserve, and disclose your account information, communications, and any other content if we believe in good faith that doing so is reasonably necessary to: (i) comply with legal process, court order, subpoena, or applicable law; (ii) enforce these Terms; (iii) respond to claims that any content violates the rights of third parties; (iv) protect the rights, property, or personal safety of Fuse, our users, or any other person; or (v) investigate, prevent, or take action regarding suspected illegal activity, fraud, or abuse.
Ownership. You retain ownership of the photos, text, profile information, and other content you upload to Fuse ("Your Content").
License to Fuse. By uploading Your Content, you grant Fuse a worldwide, non-exclusive, royalty-free license to host, store, use, copy, display, reproduce, and distribute Your Content solely for the purpose of operating, providing, securing, and improving the Services (including, for example, displaying your profile to other users and storing message history). This license is limited to the operation of the Services and does not grant Fuse the right to use Your Content for general advertising or promotional purposes outside the App without your separate consent.
Content Standards. You represent and warrant that Your Content:
You are solely responsible and liable for Your Content, and you agree to indemnify, defend, and hold us harmless from any claims arising from Your Content, as further described in Section 12.
Sole Responsibility. You are solely responsible for your interactions with other users, both online within the App and offline in person. Fuse is a venue for users to meet one another; we do not, and cannot, control the conduct of users outside of the App.
ASSUMPTION OF RISK; RELEASE. YOU UNDERSTAND AND ACKNOWLEDGE THAT MEETING OTHER USERS IN PERSON CARRIES INHERENT RISKS, INCLUDING BUT NOT LIMITED TO THE RISK OF PHYSICAL HARM, EMOTIONAL HARM, SEXUAL ASSAULT, KIDNAPPING, ROBBERY, FRAUD, IDENTITY THEFT, STALKING, HARASSMENT, COMMUNICABLE DISEASE, AND DEATH. YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE SERVICES AND WITH ANY IN-PERSON OR ONLINE INTERACTION WITH ANY OTHER USER. YOU AGREE THAT FUSE INTERACTIVE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND AFFILIATES (THE "FUSE PARTIES") ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, AND YOU HEREBY RELEASE THE FUSE PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, DAMAGES, RIGHTS, AND CAUSES OF ACTION OF ANY KIND, KNOWN OR UNKNOWN, ARISING OUT OF OR RELATING TO YOUR INTERACTIONS WITH ANY OTHER USER, INCLUDING BUT NOT LIMITED TO BODILY INJURY, EMOTIONAL DISTRESS, PROPERTY DAMAGE, AND DEATH.
California Residents: You expressly waive the protections of California Civil Code §1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

FUSE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR IDENTITY VERIFICATION CHECKS ON ITS USERS. WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT, IDENTITY, AGE, HEALTH, PHYSICAL CONDITION, INTENTIONS, LEGITIMACY, CRIMINAL HISTORY, OR VERACITY OF USERS. WE DO NOT VERIFY WHETHER USERS ARE WHO THEY CLAIM TO BE, NOR DO WE SCREEN USERS AGAINST ANY SEX-OFFENDER REGISTRY, CRIMINAL DATABASE, OR OTHER PUBLIC RECORD.
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. WE CANNOT, AND ANY REPORTING, BLOCKING, OR PRE-SCREENING TOOLS DO NOT, GUARANTEE YOUR SAFETY AND ARE NOT A SUBSTITUTE FOR FOLLOWING THE SAFETY TIPS AND OTHER SENSIBLE SAFETY PRECAUTIONS. ALWAYS USE YOUR BEST JUDGMENT AND TAKE APPROPRIATE SAFETY PRECAUTIONS WHEN COMMUNICATING WITH OR MEETING NEW PEOPLE. COMMUNICATIONS RECEIVED THROUGH THE SERVICES MAY RESULT FROM USERS ENGAGING WITH THE SERVICES FOR IMPROPER PURPOSES, INCLUDING FRAUD, ABUSE, HARASSMENT, OR OTHER IMPROPER BEHAVIOR.
We reserve the right (but have no obligation) to conduct criminal background checks or other screenings (such as sex-offender registry searches) at any time using available public records, and you authorize us to do so. Any decision by Fuse not to conduct such a check, or to conduct one with respect to one user but not another, does not create any duty owed to you or any other user.
By You: You may delete your account at any time through the App's settings.
By Us: We may suspend, restrict, or terminate your account at any time, with or without notice, for any reason or no reason, in our sole discretion, including but not limited to:
Consistent with applicable law, you understand and agree that Fuse may not share information with you regarding your account termination if doing so would potentially impair the safety or privacy of other users. If your account is terminated for any reason, these Terms continue and remain enforceable between you and Fuse, including Sections 5 (license to Your Content), 6 (Assumption of Risk), 7 (No Background Checks), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Dispute Resolution), 12 (Indemnification), 14 (Governing Law and Forum), and 15 (General).
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT REPRESENT OR WARRANT THAT:
FUSE ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER USER OR THIRD PARTY POSTS, SENDS, RECEIVES, OR ACTS ON THROUGH THE SERVICES, NOR DOES FUSE ASSUME ANY RESPONSIBILITY FOR THE IDENTITY, INTENTIONS, LEGITIMACY, CONDUCT, OR VERACITY OF ANY USERS WITH WHOM YOU MAY COMMUNICATE THROUGH THE SERVICES, ON OR OFF THE SERVICES. ANY MATERIAL OBTAINED THROUGH USE OF THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FUSE INTERACTIVE LLC OR THE FUSE PARTIES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, FIXED, OR ENHANCED DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES; (II) THE CONDUCT OR CONTENT OF ANY OTHER USER OR THIRD PARTY ON OR THROUGH THE SERVICES, WHETHER OCCURRING ONLINE OR IN PERSON; OR (III) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT, EVEN IF FUSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FUSE'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100), OR (B) THE AMOUNT, IF ANY, YOU PAID TO FUSE FOR THE SERVICES DURING THE TWENTY-FOUR (24) MONTH PERIOD IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST FILE A LAWSUIT, ARBITRATION, OR ANY OTHER LEGAL PROCEEDING AGAINST FUSE.
THE LIMITATIONS SET FORTH IN THIS SECTION APPLY (I) REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, WHETHER DEFAULT, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, STRICT LIABILITY, OR OTHERWISE; (II) IRRESPECTIVE OF THE TYPE OF BREACH OF RIGHTS, PRIVILEGES, OR OBLIGATIONS; AND (III) WITH RESPECT TO ALL EVENTS, THE SERVICES, AND THIS AGREEMENT. THESE LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY SET FORTH IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU. TO THE EXTENT ANY LIMITATION IN THIS SECTION IS PROHIBITED BY APPLICABLE LAW, THAT LIMITATION DOES NOT APPLY TO YOU, BUT ALL OTHER LIMITATIONS REMAIN IN FULL FORCE AND EFFECT.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
11.1 Informal Dispute Resolution. Before bringing a formal legal action against Fuse, you agree to first contact us at contact@fuseapp.co with a detailed written description of your claim, including (i) your full name, (ii) the email address or phone number associated with your account, (iii) a detailed description of the nature and factual basis of your claim, and (iv) the specific relief you are seeking. You and Fuse will then engage in good-faith negotiations for at least sixty (60) days to attempt to resolve the dispute. Completion of this informal dispute resolution process is a condition precedent to filing any arbitration demand or small-claims action, and any applicable statute of limitations will be tolled while you and Fuse engage in this process.
11.2 Binding Individual Arbitration. If the dispute is not resolved through the informal process within sixty (60) days, you and Fuse agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with Fuse (a "Dispute") shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in English by a single neutral arbitrator. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
11.3 Class Action and Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FUSE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO LITIGATE DISPUTES IN COURT, IN FAVOR OF INDIVIDUAL ARBITRATION. YOU AND FUSE EACH FURTHER WAIVE THE RIGHT TO FILE OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, CONSOLIDATED ACTION, OR PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS, REPRESENTATIVE, OR CONSOLIDATED PROCEEDING. IF A COURT DETERMINES THAT THIS CLASS-ACTION WAIVER IS UNENFORCEABLE AS TO ANY PARTICULAR CLAIM, THEN ONLY THAT CLAIM SHALL BE SEVERED AND PROCEED IN COURT, WHILE ALL OTHER CLAIMS REMAIN SUBJECT TO ARBITRATION.
11.4 Exception — Sexual Assault and Sexual Harassment Claims. Notwithstanding anything in this Section to the contrary, claims of sexual assault or sexual harassment may, at the election of the alleging party, be brought in a court of competent jurisdiction rather than in arbitration, consistent with the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021 ("EFAA") or any successor statute or other applicable law.
11.5 Exception — Small Claims Court. Either party may bring an individual claim that qualifies for small-claims court in a small-claims court of competent jurisdiction in lieu of arbitration.
11.6 Exception — Injunctive Relief for Intellectual Property. Either party may bring an action in court for injunctive or other equitable relief to protect intellectual property rights pending the outcome of arbitration.
11.7 Opt-Out. You may opt out of this Arbitration Agreement (Section 11) by sending written notice of your decision to opt out within thirty (30) days of first accepting these Terms to contact@fuseapp.co with the subject line "Arbitration Opt-Out." Your notice must include your full name, the email address associated with your account, and a clear statement that you are opting out. Opting out of arbitration will not affect any other provision of these Terms.
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Fuse Interactive LLC and the Fuse Parties from and against any and all claims, demands, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your access to or use of the Services; (ii) Your Content; (iii) your conduct toward any other user, whether on or off the Services, including any in-person interaction; (iv) your violation of these Terms; or (v) your violation of any rights of another person or entity, including any intellectual property, privacy, or publicity right. SOME JURISDICTIONS DO NOT ALLOW INDEMNIFICATION, SO SOME OR ALL OF THIS SECTION MAY NOT APPLY TO YOU.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App, on this page, or by other means. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services. Notwithstanding the foregoing, any material changes to the Limitation of Liability in Section 10 or the Dispute Resolution provisions in Section 11 will require your affirmative acceptance.
These Terms and any Dispute (except where prohibited by law) shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-laws principles, and by the Federal Arbitration Act with respect to Section 11. To the extent any Dispute is not subject to arbitration under Section 11 (for example, claims falling within the EFAA exception or small-claims-court actions), and except where prohibited by law, you and Fuse agree that such Dispute shall be brought exclusively in the federal or state courts located in New York County, New York. You and Fuse each consent to the personal jurisdiction of those courts and waive any claim that those courts constitute an inconvenient forum.
Entire Agreement. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Fuse regarding the Services, and supersede all prior agreements, representations, and arrangements, written or oral.
Severability. If any provision of these Terms is held invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms or any rights granted hereunder. We may assign or transfer these Terms, in whole or in part, without restriction.
Survival. All provisions that by their nature should survive termination of these Terms shall survive, including without limitation Sections 5 (Your Content license), 6 (Assumption of Risk), 7 (No Background Checks), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Dispute Resolution), 12 (Indemnification), 14 (Governing Law and Forum), and 15 (General).
No Agency. No agency, partnership, joint venture, fiduciary, or employment relationship is created by these Terms.
For users residing in New York: Fuse does not currently offer paid subscriptions or function as a "dating service" within the meaning of New York General Business Law §394-c, but we recognize and respect the protections it provides. If and when Fuse offers paid subscriptions or other services that bring it within the scope of §394-c, applicable disclosures will be added to these Terms and presented at the point of purchase.
For users residing in California: Pursuant to California Civil Code §1789.3, California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
